The Conveyancing Process for First-Time Buyers

If you’ve had your offer accepted and are wondering what happens next, don’t worry. Our team is here to guide you through each step of the conveyancing process with clear, practical advice and regular updates. The process typically goes as follows:

 

Instructing Solicitors

Once your offer on a property is accepted, the first step is to instruct a solicitor. This simply means officially asking us to handle the legal work on your behalf. We’ll open your file, provide a clear quote, and get started on the necessary checks.

At this stage, we’ll carry out identity verification and request details about your mortgage, deposit, and any third-party contributions such as a gifted deposit from family.

Reviewing the Contract Pack

The seller’s solicitor will send us a contract pack which includes vital documents such as the draft contract, property title, and protocol forms outlining key details about the home. We’ll carefully review everything, raise any legal enquiries, and make sure there are no issues that could delay or affect your purchase.

If the property is leasehold, we’ll also obtain and review the Leasehold Management Pack to ensure you fully understand your responsibilities and any service charges.

Carrying Out Property Searches

We’ll carry out a series of legal searches with the local authority and other relevant bodies to uncover any issues that could affect the property. These usually include a local authority search, which checks for planning permissions, road schemes or enforcement notices; a water and drainage search, confirming the property’s connection to mains services; and an environmental search, which looks at risks such as flooding or contaminated land.

Depending on the location, we may also recommend additional searches. For example, a mining search if the property is in an area with historical mining activity. We’ll advise you on exactly what’s needed and explain the results clearly so you can make informed decisions.

Reviewing Your Mortgage and Survey

We’ll receive a copy of your mortgage offer directly from your lender and review the terms to ensure they align with your contract. It’s also wise to arrange a private survey at this stage. This isn’t the same as a valuation. A survey gives a more detailed view of the property’s condition, helping you avoid surprises after you move in.

Signing and Exchanging Contracts

Once you’re happy to proceed, we’ll send you the final legal documents to sign, including the mortgage deed and the purchase contract. We’ll agree a completion date with the seller and exchange contracts, making the deal legally binding.

At this point, you’ll usually pay your deposit (typically 5–10% of the purchase price), which we’ll hold and transfer on your behalf.

Completion Day

On completion day, we’ll send the balance of the purchase price to the seller’s solicitor. Once the funds are received, you can collect the keys and move into your new home!

We’ll then submit your Stamp Duty Land Tax (if applicable) to HMRC and handle the registration of your ownership and mortgage with HM Land Registry.

  • Stamp Duty Land Tax (SDLT) can be significantly reduced for First Time Buyers, but should still be considered.
  • Surveyor’s fees. While not legally required, having a survey carried out is strongly recommended. It helps identify any structural issues or costly repairs before you commit to the purchase.
  • Insurance costs, as this can be required by mortgage lenders.
  • Moving Costs such as removals, setting up utilities, buying furniture or appliances, and making any immediate improvements to your new home.

Do I need a solicitor to buy my first home?

Yes, buying a property involves a legal process known as conveyancing. Your solicitor will handle the legal checks, searches, contracts, and transfer of ownership on your behalf. At Rowlinsons, we make this process clear and manageable from start to finish.

How long does the conveyancing process take?

On average, a straightforward purchase takes between 8â€â€œ12 weeks from offer acceptance to completion. Timescales can vary depending on factors like mortgage approval, property chains, and search results. We’ll keep you updated every step of the way.

What is a gifted deposit?

A gifted deposit is money given to you, often by a parent or family member, to help with your home purchase. Mortgage lenders require this to be formally declared, and we’ll handle the paperwork to ensure everything is in order.

Do I need to pay Stamp Duty as a first-time buyer?

If you’re buying a property for up to £300,000, you won’t pay any Stamp Duty. If the purchase price is between £300,001 and £500,000, you’ll pay 5% on the portion above £300,000. If the price is over £500,000, standard rates apply. We’ll calculate this for you and manage payment to HMRC.

Can I buy with someone else as a first-time buyer?

Yes, but both buyers must meet the first-time buyer criteria to qualify for any Stamp Duty relief. We’ll also advise you on the best way to legally hold the property, either as joint tenants or tenants in common, and can prepare a Declaration of Trust if needed.

What’s the difference between leasehold and freehold?

With a freehold, you own the property and the land it stands on. With a leasehold, you own the property for a fixed period but not the land it sits on, and you may need to pay ground rent or service charges. We’ll explain any lease terms and ensure you understand your rights and obligations.

Do I need a survey?

While not compulsory, we strongly recommend a survey to assess the condition of the property. A survey can reveal structural issues or hidden problems and help you make an informed decision. We’ll guide you on the types of survey available.

What happens if the purchase falls through?

Unfortunately, this can happen. If your transaction doesn’t complete, we’ll only charge for the work carried out to that point, and we’ll refund any third-party fees for services not yet provided. We’ll also help you get back on track when you’re ready to resume your search.

What is the difference between exchange and completion?

Exchange of contracts is the point at which your purchase becomes legally binding. You’ll sign the contract, pay your deposit, and agree a fixed completion date with the seller. Completion is when the rest of the money is transferred, and you receive the keys to your new home.

Can I use a Lifetime ISA or Help to Buy ISA?

Yes. If you're using either of these savings schemes, we’ll handle the legal aspects of claiming your government bonus. We’ll also ensure all documentation is submitted correctly and on time so the bonus can be applied towards your purchase.

Do I need to visit your offices in person?

No. While you're welcome to visit us in Frodsham or Runcorn (Sutton Weaver), we can handle everything remotely via phone, email, or post. Most of our first-time buyer clients complete the entire transaction without coming in.

When do I pay my deposit?

You’ll usually pay your deposit, typically 5% to 20% of the purchase price, just before contracts are exchanged. We’ll give you plenty of notice and provide secure details for transferring the funds.

What is a mortgage offer and when do I get it?

Once your lender is satisfied with your application and any property valuation, they’ll issue a formal mortgage offer. This is the document we need to proceed. We’ll review the terms and make sure everything is in order before you commit.

What happens after completion?

After you move in, we’ll pay any applicable Stamp Duty on your behalf, register you as the new owner with HM Land Registry, and confirm once that’s complete. We’ll also send you copies of your title deeds and documents for your records.

Can I pull out after making an offer?

Yes, up until exchange of contracts, either party can withdraw from the transaction without legal penalty. We understand things can change, and we’re here to support you whether you proceed or need to pause.

What if I'm buying with a partner and we split up later?

If you’re buying with someone else, we recommend discussing how ownership will be structured in advance. We can prepare a Declaration of Trust to record each person’s financial interest, helping avoid disputes later on.
