This week is Good Divorce Week which is an annual campaign organised by Resolution to promote a less confrontational and more child-focused approach to divorce and separation. Resolution are an organisation of over 6,500 family justice professionals who promote a code of conduct which sets out the principles of a non-confrontational approach to family matters. The codes of conduct include avoiding inflammatory language, promoting communication and collaborations wherever possible in order to guide clients through the options available to them. As members of Resolution, we adopt a constructive and understanding approach when dealing with matrimonial matters for our client’s and also when dealing with the other parties or their appointed legal representative.
We appreciate that divorce is a difficult and often very emotional time in a person’s life and so the idea of a “Good Divorce” may seem impossible. Good Divorce Week aims to challenge the conception that divorce has to be contentious and argumentative whilst raising awareness that by working together it can often make for a more effective process. In 2022, the law surrounding divorce was reformed and “no-fault divorce” was introduced which means that the need for blame was removed, which saw the beginning of a more constructive and cooperative movement in relation to the divorce process.
By having a family solicitor who adheres to the Resolution code of practice, it is often the case that a resolution can be reached quicker as the parties and their solicitor are able to work together in a collaborative manner to reach an amicable conclusion. Where there are any areas of contention between parties, where appropriate, mediation is a great tool to facilitate discussions in a natural environment, helping parties in dispute work through the issues together to reach a mutually agreeable solution.
